To be eligible to make a claim against an Estate you must be an ‘eligible person’ under the Succession Act such as a spouse, former spouse, child, grandchild or someone who lived with the deceased and was financially dependent on them. A spouse can be someone who was married to the deceased or a de facto spouse, as long as they lived with the deceased for at least 2 years before their death.
